Novelties, based out of Greenwood Indiana 46142 and may be referred to within these Terms and Conditions as "www.Portal of Passion.com", "we", "our", "us", or "site". It is a condition of the user entering and using the site that J.E.G. Novelties disclaims any and all warranties whether expressed or implied in relation to the material and/or products published and sold on our site. Upon entering and making purchases from our site, you agree to these Terms and Conditions listed on this page along with the Shipping/Handling Agreement, Privacy Policy and Return/Exchange Policy. It is your responsibility to read and understand these Terms and Conditions before making any purchases on our site. You must agree to these Terms and Conditions in order to make purchases on the site. If you do not Agree with all Terms, Conditions and Policies outlined within this page and said pages above, you may not purchase any product from our site. We reserve the right to amend these Terms and Conditions at any time and you should always check for updates before making any purchases on the site.

 

Before entering the site, you must confirm that you are over the age of 18. By placing an order you declare that you are in fact of the appropriate legal age to make purchases from our site. If in any way, we discover that you are not of legal age, we reserve the right to suspend, cancel or reject all orders and terminate any memberships or subscriptions. All orders placed on the site are subject to availability and approval by us. We reserve the right to reject your order for any reason.

 

Product pricing is accurate at the time of entering  the information into the site, however we may change the prices of any/all products at any time. If a price change may affect your order, we will notify you of the change. Passion Points are a loyalty points program which may be used on an accrued bases based on actions performed by you as a subsidy to the final cart cost of products. This points program if offered to you if you become a member on our site. In accordance with State and Local laws, all orders will have applicable sales tax applied. Only when an order has been paid for and a confirmation email has been sent to you, will a contract be made between Portal of Passion and yourself, and the processing, packaging and shipping of purchased products may begin. Once items leave our warehouse, they are considered to be used and non-resalable. We do not accept any returns or exchanges on any product we sell. Please refer to the Shipping/Handling agreement, and Return/Exchange Policy for further details.

 

In the event of fraudulent activities, details about the event will be handed off to the appropriate fraud agencies and Law enforcement to be handled by them. Any and all outside internet "bots" are not authorized and are not allowed to be used on any part of our site.

SMS Messaging Terms and Conditions:

You agree to receive recurring automated promotional and personalized marketing text messages (e.g. cart reminders) as needed from Portal of Passion, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided on any form on our site or via phone conversation. Consent to receive automated marketing text messages is not a condition of any purchase. Standard Message & Data rates may apply. Message frequency will vary. We reserve the right to alter the frequency of messages sent at any time. We also reserve the right to change the short code or phone number from which messages are sent and we will notify you if we do so. Our messages may not be deliverable in all areas and not all devices may be supported. J.E.G. Novelties, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

Force Majeure: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is impacted by a force majeure event. A force majeure event is any act or event beyond our reasonable control such as, but not limited to, strikes or industrial action by third parties (excluding employees of J.E.G. Novelties), civil commotion, riot, invasion, terrorist attacks, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster (“Event”).

We provide the site on an "as Is" basis and are not responsible for glitches, malfunctions, disturbances, interruptions or server issues, viruses and bugs. We are not responsible for all aspects of the functionality and dependability of the website.

 

We cannot be held liable or responsible for any damages or losses related to the use of our site. This includes the ordering and use of any and all products sold within the site. These terms outlined within this page are a contract between you, and J.E.G. Novelties and no one else. Any delay or failure to act upon our rights within these terms does not indicate a waiver to exercise our rights or a waiver of you fulfilling your obligations to us. Each clause within these Terms and Conditions operate separately and if any are found to be unlawful, the remainder of the Terms and Conditions will remain in effect.
